Thailand Tourist Information: A Guide to Laws in Thailan (Part 5)

Arrested in Thailand
If you are arrested in Thailand, most foreign Embassies recommend that you contact a consular officer of your home country immediately. A consular officer should be able to recommend a Thailand lawyer for you and may set you up with a translator. Because of jurisdictional limitations, it is difficult for most foreign Embassies to do anything more than this. It is important to remember that even as a tourist of Thailand, you are subject to the laws of the Kingdom of Thailand, unless inside your home-country’s Embassy. Thai officers with the power to arrest will have little sympathy for a plea of ignorance of Thai laws and regulations.
     
Transfer of Foreign Prisoners
Thailand has treaties with the following countries, among others, regarding the transfer of prisoners: Thailand Denmark Prisoner Exchange Treaty, Israel-Thailand Prisoner Transfer Treaty, Thailand-Nigeria Prisoner Exchange Treaty, Thailand Sweden Criminal Exchange Treaty and the Thailand-United States Criminal Transfer Treaty. However, prison transfers normally involve very serious crimes with long sentences.  Transfer of prisoner treaties mean that if a foreigner is sentenced and imprisoned in Thailand, he can be transferred to a prison in his home country. Nearly all of the treaties specify that if the sentence is for a period with a fixed ending date, life imprisonment, and/or applies to a mentally ill person or a juvenile, then the treaty is effective. 

Most transfer of prisoner treaties are ineffective if the foreigner commits a crime against the Royal family (“lese majeste” crimes), a work of national art, or a crime such as terrorism, which threatens Thailand’s national security. You are not guaranteed a transfer to a prison in your home country even if a transfer of foreign prisoner treaty exists between your country of origin and Thailand; in other words, your home country can decline your transfer despite the treaty.
    
Certain Crimes Which Carry Life Imprisonment or Death Penalty
Possession with intent to sell more than twenty grams of pure Category I narcotics, such as methamphetamines, amphetamines, and heroin, carries the death penalty or life imprisonment in Thailand (see the Narcotics section for more information on Category I narcotics and related penalties).

Sex crimes such as the following can also be punished by death or life imprisonment: raping a woman or girl resulting in death carries the death penalty; sex with a minor under thirteen years old, whether consensual or not, can carry a sentence of life imprisonment; coercing or threatening a minor between 16-18 years into sexual acts can carry a life imprisonment sentence; using prostitution as a means of income for persons sixteen or older can carry a life imprisonment sentence.

Altering any type of currency to appear more valuable than it actually is can also result in life imprisonment.  Life imprisonment and death penalty sentences can only be given to persons eighteen years old or older.
     
Prison Conditions in Thailand
Prison conditions in Thailand are notoriously bad. Much of the information about Thai prison life for foreigners is found in memoirs, biographies and online blogs. Common problems reported in Thai prisons are overcrowding; poor sleeping conditions, such as mats on concrete floors where prisoners sleep head to toe; and abuse and mistreatment from prison officers and trustees.

ဘုရားစကားဆိုတာ လိုက္နာဖို႔ ျဖစ္ပါတယ္။ နားေထာင္ရုံ သက္သက္မဟုတ္ပါဘူး။  ရွင္ယာကုပ္ကလည္း ၁း၂၂ မွာ "  ကိုယ္ကိုကိုယ္ လွည့္ျဖား၍၊ ႏႈတ္ကပတ္တရားကို နာရုံမွ်သာ ျပဳေသာသူမဟုတ္၊ တရားကိုက်င့္ေသာ သူျဖစ္ၾကေလာ့။ " လိူ႕ တိုက္တြန္းထားပါတယ္။


ကြ်န္ေတာ္တို႔က အပတ္စဥ္တိုင္း ဘုရားေက်ာင္းကို လာျပီး က်မ္းစာက ေျပာတဲ့ စကားေတြကို နားေထာင္တယ္။ နားေထာင္တဲ့အတြက္ေၾကာင့္ ၀ိညာဥ္အားၾကီးသလို ခံစားရတယ္။ ဒါေပမဲ့ ကြ်န္ေတာ္တို႔ နားပဲေထာင္ေနတယ္ ဆိုရင္ ကြ်န္ေတာ္တို႔ဟာ က်န္းမာေရးကလပ္အသင္းတခုကို သြားျပီး လူေတြ ေလ့က်င့္ခန္း လုပ္ေနတာကို ၾကည့္ေနတဲ့ သူနဲ႔သာ တူပါတယ္။ လူေတြ ေလ့က်င္ခန္းလုပ္တာ ၾကည့္ရုံနဲ႔ ကိုယ္ကိုယ္တိုင္ က်န္းမာမလာပါဘူး။ ဒီအတိုင္းပါပဲ။ ဘုရားနဴတ္ကပတ္ေတာ္ကို လိုက္နာမေလွ်ာက္လွမ္းပဲ ဖတ္ရုံ၊ နားေထာင္ရုံသက္သက္သာရွိရုံနဲ့  ကိုယ့္၀ိညာဥ္အား က ပိုျပီး ၾကီးထြားလာမွာ မဟုတ္ပါဘူး။ လိုက္ေလွ်ာက္ျခင္းမရွိပဲ ၀ိညာဥ္ၾကီးထြားႏိုင္တယ္လို႔ ထင္ရင္ေတာ့ ကိုယ့္ကိုယ္ကိုယ္ လိမ္ညာေနတာပါပဲ။ နဴတ္ကပတ္ေတာ္က ေျပာတဲ့ အေၾကာင္းအရာတခုကို နားလည္သေဘာတူတာနဲ႔တင္ကို မလံုေလာက္ပါဘူး။ ကိုယ္က တကယ္ကို အေကာင္အထည္ေဖာ္ရပါတယ္။ ဘုရားရဲ့ စကားဟာ လုပ္ေဆာင္ကို လုပ္ေဆာင္ရမယ့္ အရာျဖစ္ပါတယ္။

Thai police say 71 freed in trafficking raid

BANGKOK (AFP) - Thai authorities freed 71 women and girls who had been lured into selling sex in massage parlours and karaoke bars, police said Saturday, after a crackdown on human trafficking on the Malaysian border.
      

Thirteen of those discovered were girls under the age of 18, said Lieutenant colonel Noppadon Petsut, deputy commander of police in Sadao district of Songkhla province, where the operation was carried out on Friday.
       

"The operation followed complaints by the Laotian embassy in Bangkok," he said, adding that 70 of the young women were Laotian and one was from Myanmar.
       

A Singaporean man, a Malaysian man and a Thai woman were charged with human trafficking and illegally procuring sex, Noppadon said.
       

"Charges of human trafficking are very serious and carry a maximum sentence of the death penalty," he said.
       

Police freed 59 women from a karaoke bar and another 12 from a spa near a Thai-Malaysian border checkpoint.
       

Another officer involved in the raid said it was believed that the women and girls were sold to the suspects by brokers and later forced to work as prostitutes.
       

The operation was conducted by the Thai Department of Special Investigation (DSI), Social Welfare and Human Security officials and local police.

Thailand optimistic on border reopening

THAILAND’S business community is hoping that the election of Yingluck Shinawatra’s Puea Thai Party on July 3 will lead to the reopening of the Myawaddy-Mae Sot border crossing.

The border checkpoint has been closed since July 12 last year when Myanmar’s government objected to Thai development on the Moei River, which forms the border.

The border closure was followed by heavy fighting between ethnic rebels and Tatmadaw troops in Myawaddy in early November.

However, with a new government in place in Bangkok and fighting stopped for now, businesspeople from both sides of the border say they are hoping the crossing will be reopened for trade.

“We’ve had a big problem regarding the border crossing at Mae Sot,” said Mr Prajuab Supinee, a commercial counsellor at the Thai embassy in Yangon.

“We’re trying to cooperate with the new government to see what policy will be set [regarding the Myawaddy-Mae Sot crossing],” Mr Prajuab said.

“The first thing we are trying to do is to better inform the new government about the trading relationship between Thailand and Myanmar,” he said.

Mr Prajuab said the crossing had been the most important between the two countries.

The crossing accounted for as much as 60 percent of bilateral border trade, before it was closed,” he said.
Since then traders have shifted their attentions to Kawthoung- Ranong.

But one Thai foodstuffs importer based at Kawthoung said the crossing into Thailand was too slow during the monsoon months.

“There are too many difficulties for Thai exporters here because we have too many problems to solve at once; too many things can go wrong and slow a delivery. The Myawaddy-Mae Sot crossing was much more convenient,” Mr Prajuab said.

He added that border trade through Kawthoung-Ranong had increased by up to 400pc since the Myawaddy-Mae Sot closure.

A Ministry of Commerce official said the reopening of the crossing at Myawaddy depended on Thailand.
“I think the new Thai prime minister will be helpful towards boosting trade and investment between Myanmar and Thailand,” he said.
